Sushi Train's Digital Membership

Sushi Train Point programme is the customer loyalty programme which Sushi Train New Zealand operates throughout New Zealand.

Terms and Conditions Card means any mechanism or device that holds the Member's personal identification number and points details.

By registering as a Member, requesting a Sushi Train Point, scanning or tapping your Point Card in-store, using any other deals for membership or using or attempting to collect, access or enjoy any Member Benefits, at Sushi Train Point system, you agree to these Terms & Conditions (T&C's).

Privacy Policy

Our privacy policy will apply to you in respect of the Sushi Train Point programme. These T&C's are important and you should read them fully. However, there are some specific terms we wanted to make you aware of:

  • A Member must notify Sushi Train immediately of any change of address or of a lost or stolen membership card.
  • The Card remains the property of Sushi Train and must be returned upon request.
  • To the extent permitted by law, we will not be liable to you in any way for any cause in connection with your Sushi Train Membership.
  • Sushi Train may terminate a membership of the Sushi Train Point programme, without notice and for any reason, including if the Member;
    • fails to comply with these Terms and Conditions;
    • supplies any misleading information or makes any misrepresentations to Sushi Train or to any participating establishment in connection with the Sushi Train Point programme;
    • abuses any privilege accorded to the Member under the Sushi Train Point programme;
    • does not use his or her membership card for a period of 12 months.

Collecting Sushi Train Points

Points will be assigned and recorded as in a Sushi Train Point for the members' purchase of the bill at Sushi Train (New Zealand).

A Member must, in order to receive points, present the relevant membership card before the transaction is concluded.

Sushi Train Point reserves the right to refuse Card registration or to issue points at any time.

Points will not be recorded for transactions at Sushi Train after they have ceased to be participants in the Sushi Train Point programme.

The Card cannot be used in conjunction with any other promotional offer or discount.

Claiming a Reward

A Member who has recorded sufficient points in a member points record may request a reward.

Requests must be made by the Member personally. A Member must, in order to redeem points, notify the establishment before the transaction is concluded that the transaction is a Sushi Train transaction, by presenting the relevant membership card.

Furthermore, points cannot be earned on a transaction when claiming a reward.

Deduction of Points

The number of points set out in the then-current points schedule for a reward claimed will be deducted from the points balance of the Member's points record, with the oldest points being deducted first.

Sushi Train may also deduct from the points balance in a Member's points record:

  • any points recorded in error;
  • any points relating to a transaction which is cancelled or where a refund is given;
  • any points which are not used by a Member to claim a reward within 12 months after the date which the points were recorded. These will expire and be deducted from the points balance in a Member's points record.

Personal Information

In this section, personal information means any information that can identify you either directly or indirectly (i.e., by reference to other information we have access to) such as your name, address, email address or phone number.

Your personal information may be collected by Sushi Train when you register for, and participate in, the Sushi Train Point programme.

Your personal information may be used by Sushi Train, and its employees, officers and agents, for the following purposes:

  • To confirm your identity and communicate with you in relation to the Sushi Train Point programme.
  • To manage, administer, develop, improve and otherwise operate the Sushi Train Point programme.
  • To decide what marketing information to send to you and where to place adverts on websites and social media (unless you opt out of marketing communications).
  • To comply with New Zealand law and our obligations to regulatory agencies.

You may choose not to give us any of your personal information that we request. However, this may mean that we will be unable to properly provide you with the benefits of the Sushi Train Point programme.

Specifically, you are not required to give us any of your personal information for the purpose of earning points under the Sushi Train Point programme. However, you will be required to give us your personal information that we request for the purpose of redeeming points under the Sushi Train Point programme. You consent to the collection and use of your personal information in the manner set out above and the disclosure of such information to:

  • Any agency with your consent.
  • Third party service providers that support the Sushi Train Point programme, including any third party that hosts, maintains or provides any underlying IT system, software or data centre that we use to operate the Sushi Train Point programme. These third parties are prohibited from using your information for their own promotional purposes.
  • Any agency where required to meet a legal obligation.
  • Any retail establishment participating in the Sushi Train Point programme (subject to change from time to time) if:
    • you consent in writing to such disclosure; or
    • Sushi Train considers on reasonable grounds that such disclosure is necessary to enable the recording of points in relation to any of your transactions in connection with the Sushi Train Point programme or to otherwise facilitate your participation in the Sushi Train Point programme; or
    • Sushi Train considers on reasonable grounds that you may have been involved in fraudulent activities in relation to that retail establishment.

You have the right to ask us not to use your personal information for marketing purposes. You can exercise your right to opt out of our marketing communications by clicking unsubscribe when you receive a marketing communication from us or by contacting us at sushitrain.viaduct@gmail.com.

If you do opt out, we may still need to send you operational communications (in connection with the Sushi Train Point programme) in accordance with these terms.

We will retain your information for as long as it is needed to provide the benefits of the Sushi Train Point programme to you. If you are no longer registered for the Sushi Train Point programme, we will only keep your information if it is necessary or required to meet legal or regulatory requirements.

You may, under the provisions of the Privacy Act 2020, request access to, and correction of, your personal information held by Sushi Train. These requests must be in writing. A fee may be charged for the reasonable costs incurred in responding to these requests. Any such fee will be disclosed to you before it is incurred. We will usually respond to you within 20 working days after receiving your request.

General

Points, and any rights they confer, cannot be sold, transferred, assigned or otherwise dealt with, except in accordance with these Terms and Conditions. Points have no cash or monetary value.

Sushi Train may change at any time, and without prior notice, these Terms and Conditions, the reward schedule and/or the participating establishments.

Sushi Train may make changes even if it has the effect of reducing or extinguishing the number or value of, or the period for expiry of, any existing or future points.

Sushi Train is not obligated to notify you of any changes.

Sushi Train reserves the right to suspend or terminate the Sushi Train programme at any time without prior notice.

Sushi Train is not liable for any delay in replacing a membership card or for any unauthorized use of a membership; for any failure of a member to notify a participating establishment that a transaction is a Sushi Train transaction; a lost or stolen card; any failure to notify Members of any changes in these Terms and Conditions, the reward schedule, participating establishments, the suspension and/or termination of the Sushi Train programme.

In these Terms and Conditions, the Sushi Train Point programme means those arrangements by which a Member receives points by purchasing qualifying goods from participating establishments and so qualifies for rewards under these Terms and Conditions.
